Photoshop Express – Not all it’s cracked up to be?
Well, Adobe appeared to do the world a favour today, by launching its free, on-line (albeit cut down) version of Photoshop.
But, things aren’t always as they seem…The terms & conditions have got a rather important point embedded within, which essentially says that Adobe can do what they like with your pictures (you effectively granting them the rights to do so by simply agreeing to these conditions). Is this yet another instance of users of services inadvertently giving away the rights to their images by not examining the small print? Adobe additionally state that they will have the right to “derive revenue” from your photos. i.e. quite simply, if its any good, they can sell it, and you won’t necessarily see a penny.

The offending clause is….
“8. Use of Your Content.a. Adobe does not claim ownership of Your Content. However, with respect to Your Content that you submit or make available for inclusion on publicly accessible areas of the Services, you grant Adobe a worldwide, royalty-free, nonexclusive, perpetual, irrevocable, and fully sublicensable license to use, distribute, derive revenue or other remuneration from, reproduce, modify, adapt, publish, translate, publicly perform and publicly display such Content (in whole or in part) and to incorporate such Content into other Materials or works in any format or medium now known or later developed.”
So, be very aware of how you use this!
Of course, I could just be being a tad negative and paranoid, but quite simply, it wouldn’t have hurt them NOT to put the above clause in the Ts&Cs…
